QUESTIONS

  • I see repeatedly in agreements that Tenant is "responsible" for insuring the mobile home. The Act itself doesn't address this, and the agreements also state the Act supersedes the agreements. Is insuring the mobile home a "requirement" in Arizona, or a Tenant "responsibility" which a Tenant could choose to do or not do?
  • My friend's fiance just had a baby. It was the happiest moment of his life. Then a week later, his fiance decided she that she felt trapped. She took the baby lied to file a restraining order against him so he can't see his baby. Can you please advise the best possible thing he can do to get his baby back?
  • Re: an increase in monthly maintenance fees in a housing CO-OP (not apt, not condo). QUESTION: Is there a percentage maximum that the monthly fees may be raised? Our by-laws say it is 20% without resident/member/owner approval, but some owner-members say it is only 5% by AZ law. (That sounds like tenant/landlord law which shouldn't apply.)   • The property owner wants to charge me HOA fees for grounds maintenance. I am a tenant in an apartment complex. When questioned, they said they could do this according to Arizona General Provisions 33-1314 and 33-1314.01. I think this addresses utilities, water and separate meters, not HOA dues. I also will not have access to CC&R's, or be able to have a seat on the board or see the financials, because (in their words) I am not an owner. Can you let me know if they can in fact charge me HOA dues?
