QUESTIONS

  • We got a HELOC and the loan was accelerated on Feb 28, 2011. Loan was sold to another company made the last payment on HELOC on 08/28/2012. We got a letter from new lender saying they charged off the debt on 05/08/2018. The letter also states “please be advised that we cannot bring a legal action to collect this debt or threaten to do so because the statue of limitations has expired. If you do make a payment, we may later be able to bring an action to collect this debt because the payment May start a new statue of limitations”. Has SOL run out, can they collect money if I sell home, 1099?
  • Our building is pretty old and the plumbing here is always giving everyone problems. Usually the owner fixes it and that's that. Well this time, the toilet is plugged up and it's the 3rd time. It wasn't fixed right the first time or the second time. Because I have been having problems with it ever since. Including right after they supposedly fixed it the first time. So this time (3rd time) the landlord (not the owner) says I have to pay her husband to fix it. I have a 14 yo son n a 17 yo daughter as well as myself who is disabled n our room mate who islike 63 yo. Do I have to pay?

  • Hello. A small fire broke out in my kitchen. Fire department and police spoke with my landlord telling her that I could not stay due to soot and it needed be taking care of. Landlord stated she spoke with owner and a team would be out to find my apartment. 1 month later nothing is fixed. I shower landlord the report from fire deapart and was told that she doesnt care what the report shows that nothing is going to get fixed. She refused to give us the owners contact info also.   • I am currently paying my arreaarages for child support, but was awarded to claim my daughter in odd years. In 2005, she would not let me take the deduction and again this year; telling me because I am not current that I cannot claim her. Is this true? If yes, what is the statute? If no, what steps do I need to take that she is not following a court order?

  • In March 2009 the deceased in probate case obtained $1000.00 and signed Promissory Note with a Deed of Trust on property he owned. He last payment made was in March 2012. He dies in August 2014 with Note and DOT still on property. Owner of the Prom Note and DOT was notified thru informal probate to file a claim but never did. I have filed the Deed of Distribution. So what do I do about this Prom Note and DOT ? And how does this affect the filing of closing statement for probate case?
