Child Support

questions & answers

Question: My fiances' ex-wife received over $100,000 in an informal inheritance- her and her brother sold property and split the equity. His payments are current and we see his son regularly. Would her receiving the inheritance change his child support obligation?

Answer: Paragraph 5(A) of the Arizona Child Support Guidelines states, "Gross income includes income from any source, and may include, but is not limited to, income from . . . capitals gains. . . . Income from any source which is not continuing or recurring in nature need not necessarily be deemed gross income for child support purposes. Generally, the court should not attribute income greater than what would have been earned from full-time employment."
