QUESTIONS

  • My landlord repaired a broken sliding glass door at my rental. It’s $280 dollars and he’s added it to next months rent. Do I have to pay the full amount next month or can I partially pay it off?
  • A credit card company recently bumped our % rate based a payment that was 4 days late. We cannot make the new payment and they refuse to work with us. Is it better to make partial payments or no payments from a legal standpoint?
  • Last year we fell behind on our home payments. We tried to work with the lender for months, Instead they set a foreclosure date. We only owe $265,000 plus the arrears on our home which is now appraising at $422k. We were forced to file Ch. 13 in order to stop the foreclosure and save our equity. My spouse now has a high income job offer out of state. We want to rent out our home instead of selling & dismiss the BK but still owe over $18k in arrears. With our bad credit due to the BK, what are our options for getting a loan to pay the arrears? Our home will rent for $2800 and our payment is 2k.
  • We moved into a home in Nov. 2014. With a 2 year lease. The owner recently told us he is selling the house but that whoever buys it will have to honor the duration of the lease. Is this true?
  • I had a default divorce awhile back while I was away on active duty. My now ex told the judge that I made $100k/yr on active duty when my income was far less than half that amount of course. Modifying her and the court's secret divorce now is easy enough, but I'm in arrears for money I couldn't pay from the divorce up until my first modification. How do I get bank statements, tax returns, paystubs and whatever else they need and should have had in the first place to a judge in order to negate a year's worth of $3,500/mo alimony that AZ DES is still trying to enforce? -Making me a homeless vet
  • My husband has no papers. He has been served with petition to establish child support. I pay everything since he cant work. I would like to know if child support will become my responsibility in this case, since he does not work and if there is anything I can do. Thank you.
  • My son is abt to be 4 years old. He has my last name because while I was pregnant his father was abusive physical & emotionally hurting me , he was also abusing drugs and dealing drugs . He was putting too much stress on me I wanted him as far away from me as possible it wasn't good for my pregnancy . When I had my son only my last name was given . His dad & I try working it out but throught out time he was still being abusive , doing drugs getting d.u.i going to jail . Cheating on me I had enough . I met a wonderful man that I fell in love with as soon as I moved on my sons father broke into my apartment & vandalized 3000 worth of my things .. I don't get a penny from the guy . Now he has a black on blank Benz . He has a Bently he has a monster truck . He has a motor cycle hardly Davidson & dune buggy while I'm struggling with my son to get by . My boyfriend was supporting us him & I are no longer together . How can I get child support from the guy without him getting any legal right
  • My Park charged me a $5 per day late fee on unpaid late fees. Is this legal in Arizona? The park applies any payment made to the amount due, thus guaranteeing that any payment made that is less than the entire amount owed will be subject to late fees for the entire time additional money is owed. I believe there are laws preventing that practice for mortgages but I'm unsure about rentals or leases. Shouldn't payments first be applied toward the monthly rent or lease and then any additional payment be applied to late fees? And isn't it illegal to charge interest or fees on late fees?
  • I have lived in my apt for 19 years now,my landlord will not fix a thing, i have asked several times, i have the same carpet it's been shampooed over & over, it's horrible when asked he said he'd have to raise my rent, isn't that his responsibility to replace it after so many years. My outside steps have giant holes, moldy when it rains and the rails all shake he refuses to fix them, do i or someone else have to get hurt first, they are very dangerous but yet pass inspection, which i know he's paying them off, what can i do?
  • If I get a divorce in Arizona and sale our house wouldn't the equity that we split be enough to not have to pay alimony or will the Judge still award a maintenance amount of money to wife. Thanks.
