QUESTIONS

  • If my child's father currently doesn't have a job or any source of income, am I still able to file child support against hi?
  • I have joint legal and physical custody of my daughter (12). The access schedule we agreed to equals exactly 50/50 physical custody. Because of my work schedule (2:30-11:00pm M-F), my current wife and family members pick my daughter up from school and care for her in the evenings during the week. My question is, would a judge penalize me for not being the one physically with her during those times when figuring child support?
  • I never signed a lease when I moved in to my current home in Scottsdale. I did, however, give a 'last months' rent as a deposit. How much notice is required by law prior to move out, and am I able to recover the balance if I gave a notice on the 10th of the month, had already paid that month's rent in full, and would like to receive the full 'last month's rent deposit back?.
  • I live in an apartment complex. On July 26th, 2014, there was a storm and a tree planted on the premises fell onto my car. The apartment complex removed it two days later. They claim it was an "act of God", and won't cover the repairs for the damages to my vehicle. My question is this: Would this fall under the provisions in the Arizona Residential Landlord and Tenant Act, section 33-1324, Landlord to maintain fit premises?
  • My lease is up April 10. It requires 60 day notice. If I go to month to month, am I still required to give 60 days notice for move out, or is 30 days sufficient since I will no longer be under the lease?
  • I became disabled during our marriage. After that time, she was able to get a good paying job with benefits incl, profit sharing, retirement, etc.I have become dependent on her income to pay for bills incl. basics.Am I entitled to spousal maintenance?
  • I WAS MARRIED IN AZ IN 2006 AND BECAME LEGALLY SEPARATED IN 2011. OUR FINANCES ARE SEPARATE AND WE ARE NOT ON EACH OTHERS CREDIT CARDS, CHECKING ACCOUNTS OR ANY OTHER LEGAL DOCUMENTS. IF HE PASSES AWAY AM I RESPONSIBLE FOR HALF THE DEBT HE INCURRED DURING THE FIRST 5 YEARS OF OUR MARRIAGE EVEN THOUGH HIS DEBT HAS NEVER BEEN IN MY NAME?
  • A few days before I turned 18, my adopted family of 4 years kicked me out and dropped me off at my birth mothers house. (Who is not capable of taking care of me) they didn't even give me a quarter of my belongings and I also didn't receive any of my documents (I.e birth certificate, social security card, etc) this has caused me many problems in the year since dealing with trying to get a car, registering for college and other things. In order to get new documents, I need to have other documents and I have none. Is there something I can legally do?
  • I recently had to get an Injunction Against Harassment against someone. They set a court date to contest it. I went to court, but the defendant never showed up. The Injunction is still in place. Can the defendant ask for another court date or legally contest it again. They were notified of the court date, since they requested it, so the court labeled them as "did not appear and had notification of the hearing date and time". This has been a very stressful ordeal. I want to know if I can breathe again or if I can expect to have to go to court again if the defendant requests it.
  • My daughter and her son have lived with me and my husband since my grandson was born. the father of the baby left when he was 3 months old and moved back to his home state of KY. He did sign the birth certificate and my daughter is going for child support through the state, but the father does not call, visit or show any interest in my grandson. My question is, what would happen if my daughter became ill or passed away- by law does my grandson have to move to KY to live with a biological father he has never known or is there something I can do now for reassurance this baby won't be taken.
