QUESTIONS

  • My husband recently took a plea agreement and though he was signing for disorderly conduct. Once we got the paperwork home it indicates that it is domestic violence. There is also several other items on the form that were not told by us by the prosecutor. Can we appeal? Both "victims" in this case were trying to call an ambulance, not the police. They have both written letters stating that they were never in any danger and told the police that evening when they came. Also, the defendant signed the plea just hours after leaving the hospital. We feel duped into taking this plea.
  • Me and my husband got married in 2010 and a year ago we separated I want a divorce but we never filed for his citzenship and he won't divorce me because he doesn't want to be deported. What should I do???
  • I am the landlord and the toilet water line burst and flooded apartment. I am paying to have everything replaced and cleaned up but the tenant has to vacate for 2 days. Do I have to pay for a hotel for them to stay in?
  • I am in Arizona, my daughters father lives in California. I am letting her go to California to be with her father for a couple weeks. What happens if he does not want to give her back?
  • This is our 2nd year of renting in a Phoenix apartment building. Over the past few months the smell of marijuana or some kind of drugs is consuming our apartment, through the a/c vents. On a daily basis, our family has headaches and we are concerned for our 18 month grandchild. Our lease ends in 8 months and cannot deal with this for that long. What rights do we have and is it legal for us to break our lease without action taken against us?
  • I have been asked to appear in court in person during the month of September I am being charged with violation of ARS: 13-3619. Basically I left my son in a car for about 15 minutes with the windows rolled down because he absolutely REFUSED to get out of the car. Knowing I just had to pick up one item from the shoe store, I "ran in" to the store to get the item. I UNDERSTAND and take FULL responsibility for my lapse in judgement. My question...do you advise me to get a lawyer for this court appearance? What is the possible punishment for this violation?? Thank you!! PS: I have NO record!
  • I’m a college student and was renting a room in a 3 bedroom apartment during the semester. My lease ends June 30th, but with COVID, I was out of work and had to move back home. I haven’t been at the apartment since probably the middle of February. I turned my keys in and gave 60 days notice/ lease termination contract. I can’t file for hardship due to unemployment because my parents are guarantors. I understand I might have to finish paying my rent (leasing agreement) but is there anything I can do since I have not been there in over 4 months? I had to move back home (Flagstaff to Mesa)
  • I WAS MARRIED IN AZ IN 2006 AND BECAME LEGALLY SEPARATED IN 2011. OUR FINANCES ARE SEPARATE AND WE ARE NOT ON EACH OTHERS CREDIT CARDS, CHECKING ACCOUNTS OR ANY OTHER LEGAL DOCUMENTS. IF HE PASSES AWAY AM I RESPONSIBLE FOR HALF THE DEBT HE INCURRED DURING THE FIRST 5 YEARS OF OUR MARRIAGE EVEN THOUGH HIS DEBT HAS NEVER BEEN IN MY NAME?
  • My ex husband and I have joint custody and he has court ordered visitation. He was a recovering alcoholic during our divorce and has since relapsed. He planned on going to rehab but his insurance will not cover it so he has not taken his visitation in 3 weeks. According to him he is being evaluated for psychiatric disorders in place of rehab. He struggles with compulsive lying, gambling, sex addiction. I suggested counseling for our children and he blew up and denied approving such care. He now says he will start taking his visitation again but is very unstable. What can I do to keep kids safe
  • I recently rented a house from an individual. To my surprise, after paying all the rent for first month, is that the person I rented this from has signed a relocation agreement with the bank and forced us out of the household in less than a month. Under what statues am I able to pursue this individual? The lease still has 5 months left in contract and we've since been locked out of the household and the landlord has taken a few appliances and other belongings. Thanks in advance!
