Visitation
questions & answers
Question: my wife asked me to leave the house 9 months ago. We now live in 2 different counties. She is very controlling of the time that i can spend with my daughter. So, I would like to go to court in order to let them set up some sort of visitation with my daughter for me, something more concrete than just my ex's wims and how she's feeling on the days I want to see my daughter. How do I go about filing for visitation rights. Please help- I am missing my daughter terribly and I know I should be able to see her. Thank You
Answer:
Parental Visitation rights in Arizona, commonly referred to as Parenting Time, are established either between the parents of the child or by a court order from the Superior Court of the presiding county. State law entitles a parent to reasonable rights of parenting time as long as it remains in the best interest of the child. Information about Custody and Parenting Time in Arizona can be found in the "Things you Should Know about Custody and Parenting Time" article on this website. You may be able to find the steps toward receiving a court order for Visitation Rights through the self service center at your local Superior Court. Some counties have information available online; such as Maricopa, Pima and Coconino.
