Question: I recently went through a child custody hearing. In the judges ruling, he claimed that I was convicted of Domestic Violence and that I was abusing te legal system by reporting Domestic violence by my ex. I have never been charged but my ex has been 12 times with 5 convictions and 5 other charges dismissed as part of plea agreements. Do I have any recourse against the judge?
Answer: You may want to consider filing a supplemental notice to the court clarifying the point that you do not have any criminal convictions for domestic violence to clear the record, and educate the judge. Perhaps ask for a new finding on the record by the judge and reference the previous order or findings of the judge. I would take that approach first to see if the judge issues a new order or finding. You do have options to file a judicial complaint with the Arizona Supreme Court, however, I would try to get the issue cleared up with the judge before taking any actions with the Supreme Court.
