Question: In the state of Arizona in a no - fault divorce does the state require a period of separation
Answer:
No. The statute setting out the grounds for dissolution of marriage is Arizona Revised Statute, Section 25-312. The statute requires:
1. That at least one of the parties reside in Arizona;
2. Neither party has applied to conciliation court for counseling to save the marriage;
3 The marriage is irretrievably broken;
4. If there are children, the court has been given a chance to provide for custody, visitation and support.
If you are not in conciliation court, you can file when you choose.
