questions & answers

Question: I have a big root right down middle of my drive, splitting blacktop in half and lifting it up.i did not plant the tree.is park responsible for root removal and fixing my drive?i have to straddle my car over it.

Answer: Under the Arizona Mobile Home Parks Residential Landlord and Tenant Act, mobile home park landlords are required (among other things) to “make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition” (A.R.S. 33-1434). Tenants who want their landlords to make repairs required by A.R.S. 33-1434 should make such requests in a signed and dated writing and keep a copy for their own records.
