Question: My ex is trying to go after me for child support. I only make 600 a month and im married. Will the courts go off my husbands income and make me pay more because he makes more? I believe my ex makes more then me in disability.

Answer: Under the Arizona Child Support Guidelines, the income from your current spouse cannot be considered in the calculations.  The law allows the court to consider all sources of your individual income, but not that of your new husband.  You do not say whether the children live with you or with the other parent; nor do you mention how much parenting time each parent has.  Those things are also considered in determining each parent's duty of support.  If your ex has primary custody (legal decision-making) and the children live primarily with the ex, you may be ordered to pay some support.  Arizona law imposes a duty of support on all parents.  [A.R.S. Section 25-501].  Thus, even if your ex makes more money than you, if the children do not primarily live with you, some support is likely to be ordered.
