Question: if my chilldren are in temp foster care can I request a custody of my chilldren

Answer: There is nothing to prevent parents from requesting custody of their child.  Whether or not custody is granted will depend on the recommendation of the case worker and ultimately, the decision of the court.  
When children are taken into foster care they are assigned a case worker.  That case worker is responsible for collecting and maintaining all relevant information to the case, including why the children were initially removed from the parent or guardian.  It is highly recommended that you work with the caseworker to address concerns about the environment being provided for the children.  Caseworkers may ask parents or guardians to attend parenting classes or to attend some therapy.  Cooperating with the requests of the case worker will improve the chances of a recommendation that the children be returned.
