Domestic Violence

questions & answers

Question: If a relative has lived in your home for than a year and domedtic violence was involved, do i have to give her notice before I get rid of her belongings

Answer: The Arizona Residential Landlord Tenant Act is always a good place to start. Here is a link: http://www.maricopacountyattorney.org/pdfs/community/Residential-Landlord-Tenant-Act.pdf Page 25 starts to discuss personal property (specifically A.R.S. 33-361(C)). it also refers you to A.R.S. 33-1023. These both apply if there is personal property left and rent is owed. If the person left and abandoned their personal property, you must comply with A.R.S. 33-1370. A link is here: http://www.azleg.state.az.us/ars/33/01370.htm. In general, you must send notice of abandonment and wait a period of time before you can dispose of property. Read the statute carefully. Please note that I am providing general information based on the limited information available to me at this time. I am unable to provide legal advice, and no attorney-client relationship is created. I wish you the best.
