QUESTIONS

  • The home we are renting is set to go to Trustee Auction at the end of this month. The "Protecting Tenants at Foreclosure Act" expired 12/31/2014. What are my rights as a tenant now that this has expired. Can I be evicted without notice..do I still have to receive ample notice if the new owner wishes to occupy the home?

  • Can a landlord, as part of the lease, require the tenant to agree to only require 12 hours entry notice? Our new lease includes a provision that acknowledges the appropriate section of the ARS, but does not mention the 'two days' requirement. Quoted here... "Tenant agrees that Landlord, its agents and contractors, shall have the right to enter into the leased premises, or any portion thereof, upon twelve (12) hours oral or written notice to Tenant, for the purpose of inspecting the same or performing such repairs or maintenance as the Landlord deems reasonably necessary.

I would think that by my yearly lease contract, he is not allowed to move anyone in until 5/1/11 since he accepted and cashed my 4/1/11 check.

She or someone cleared out his CDs of $50,000. Is there any legal action I can take to cover myself?
