QUESTIONS

  • Can a person who has power of attorney over a senior citizen ban family members from any contact with that senior?
  • If an undesignated felony 6 is dropped to a misdemeanor; is that person still considered a felon? Are they still required to report a felony conviction or can they legally state they are not a felon? What are the benefits of getting a felony dropped to a misdemeanor? I understand the expungement and set aside concepts but if a background check still shows a felony even though it was dropped to a misdemeanor and set aside what do we have to do to get it to show accurately and display the conviction as a misdemeanor? Whats the point if getting it dropped and set aside if it shows a felony?

At the walk-through we were told that everything was fine except a stain on the countertop which we were told that we would probably have to pay for. Two weeks later I get a letter that I have to pay to replace the carpet because it's worn more than the 36 month life limit. I have pictures of the carpet and it is not worn nor dirty.
  • We got a HELOC and the loan was accelerated on Feb 28, 2011. Loan was sold to another company made the last payment on HELOC on 08/28/2012. We got a letter from new lender saying they charged off the debt on 05/08/2018. The letter also states “please be advised that we cannot bring a legal action to collect this debt or threaten to do so because the statue of limitations has expired. If you do make a payment, we may later be able to bring an action to collect this debt because the payment May start a new statue of limitations”. Has SOL run out, can they collect money if I sell home, 1099?
