QUESTIONS

  • I currently have a tenant that has not paid their rent. It was due on the 1st and they were sent late notices. They will not return phone calls but have emailed saying they will pay and then never follow through. I sent a 5 day pay or quit notice with delivery confirmation because in the past they will not sign/pickup certified mail. It was delivered on the 17th and it says they must pay by the 22nd. When can I file for eviction? Tomorrow the 23rd or do I have to wait longer?
  • my violations are: Assault-no injury; disorderly conduct. Court date on January 29,2016. Released on signature. If the Plaintiff does not appear to press charges,will my charges be dropped? Because Plaintiff does not want to press charges. What is my next step aside from appearing in court? Do i need representation for this violations?

The landlords said they won't/don't reimburse for the hotel. I'm confused because it says in the Tenant/Landlord act that money can be withheld from rent if substitute house has to be found if the rental is uninhabitable. I have receipts for the hotel and I took the amount off the rent & now the landlords are looking to either late fee or evict me. Can they do that?! I really scared as I have two small kids & no where to go.
