QUESTIONS

  • I live in a different state. My child was on probation in Arizona and even though my custody order allows me alt. holidays and 5 weeks during the summer, the probation dept. would not allow my child to come to my home to visit. Is this legal? Can the probation dept. overrule an existing custody order?
  • Orig divorce decree and child support orders were in AZ. I now live in WA state with our child; father remains in AZ. Our child will be 18 next year but will graduate at age 19 from HS. He is deemed disabled. Father and I are in agreement re: extending child support beyond HS through community college and longer, if necessary. We know what to do re: notifying the OCSE that the child will be a full-time student in HS beyond 18. What we don't know how to handle is extending beyond HS. Do we modify existing decree/child support or new petition for this thru Superior Court in Mohave Cty? Thanks.
  • I paid my deposit to my landlord with 2 money orders. I have receipts from the landlord for both of them. The landlord "lost" one of the money orders. They are now asking me to pay them again for the lost one and for me to file the paperwork myself to see if I can get the money back from the company who issued the original money order. I feel that once it left my possession and they gave me a receipt that it is their responsibility. Can they penalize me for their mistake?
  • I made a huge mistake by cosigning on a car loan for a girlfriend back on 09/15/08. She only made 9 payments on the vehicle then let it go back to the bank. It’s been almost 6-1/2 years since she made her last payment and now they’re coming after me, after all these years have gone by. I was told that Arizona Statute of Limitations A.R.S. § 47-2725 is four (4) years for auto loans. But their attorney is ignoring that and coming after me regardless. It's now October 2015 and they are coming after me for the loan amount + interest totaling $13,000 altogether. I'm retired and living solely on Social Security of $1,776 per month and two small pensions totaling $624 which = $2,400 per month. And I'm living with my daughter to make ends meet. Therefore I can't afford to pay theses people. I had an initial pre-trial conference on 10/8/15 and represented myself because I can’t afford an attorney. It was determined that there will be a trial on 12/14/15. I told the loan company in court “that I have no money and living on $2,400 per month and living with my daughter to make ends meet, and they’re still pursuing the trial date. My questions are: 1) Will the Arizona Statute of Limitations A.R.S. § 47-2725 four (4) years get me out of this mess completely? 2) I've been told and read online that Social Security income and Pensions “cannot be garnished”. Do you know if this is true? If it's true then I have nothing to worry about and won't need to file bankruptcy. 3) If I lose my case can I file bankruptcy on a judgement that's been awarded against me? 4) Can they levy / garnish my checking account where my Social Security checks and Pension checks are electronically deposited?   • I the home owner. I had a management co. The renter tried to fix stuff on his own. EX. tub faucet was taken off and the pipe was caped off with looks like a lotion top. Internal parts of toilet was removed and not replaced. Just to name a few. The never contacted the company to have them fixed. The CO is now telling me stuff I can't charge for the renter for failing to have them so the repairs. They are also telling me that a plumber costs to much & she has a handy man that can do the job instead of the plumber. She is also said doors that have dents can be patched instead of a new door.

  • My boyfriend and I have lived together for 7 years now. Recently his health took a turn for the worst. He is still legally married and his wife says she has the right to come into our home and take whatever she wants upon his death. Is this at all possible or is she blowing smoke? He wants a divorce but hasn't been able to accomplish this because of his health.

  • I have a person living in my house with a week to week lease. Money has been missing and believe she is using drugs. I want her out of my house. How do I go about it?
  • I am renting a condo with a washing machine and dryer. The washing machine and dryer have only worked 6 out of the 9 months of my lease. The landlord replaced the appliances a few months ago, but they are now malfunctioning and flooding my kitchen when I try and do a load of laundry. A tech has been out twice to look at it, and claims there is no problem. I have asked the landlord for a break in rent this month due to the aggravation, as well as the fact that I am paying for a condo unit with a working washer and dryer. I can't get a response from my landlord or the realty company.
