QUESTIONS

  • I have had my elderly parents living with me for the last 2.5 years. We have had to buy a larger house to accommodate them plus our children. How much of the household expenses (mortgage, utilities, food, etc.) can they contribute to (they have IRA's and social security) without a tax problem for me. I do not claim them as dependents on my taxes.
  • My husband and I are separated and I need to know my rights about taking our 5 year old daughter out of state on vacation. He has a past felony and a history of domestic violence. He has been abusive towards me and that is why I left. He's never been abusive to our daughter. He is preventing me from seeing her most of the time and has forbid me from taking her out of state while I'm off work for the summer. I work at a high school and get the summer off. He doesn't work. I am the sole supporter in our family. Do I have the right to take her out of state temporarily?

  • I cohabitated with my domestic partner (DP) age 54 for 16 years.  To our friends and co-workers, we were a married couple.  Then, five years ago, my DP started a sexual relationship with a female co-worker, age 28.  The affair took on a whole new situation four years ago when she gave birth to a baby girl.  When teh baby was approximately six months old, I wanted to meet the child because my DP and I had remained together.  As it turned out, I fell in love with her as the months and years rolled by and, for the most part, my DP, the child, and I were a happy family on visiting days.  Nine weeks ago, he moved with her.  Can I ask for vistation in court?

  • Can an order of protection be issued to a defendant out of state without an arrest being mad or charges being filed?
  • I was contacted by the Sheriffs dept. and told an Order of Protection was served to me the past April. I was never served any documents or aware of this. How may I get a record (copy) of this service?
  • I am unmarried and 15 weeks pregnant. My ex fiancé is denying paternity most because he does not want the military to know he is having a child because it will cancel his assignment he signed up for that requires no dependents. I would like to legally establish paternity so that when the baby comes I will be able to apply for child support since he will most likely be deployed. I have heard mixed answers on whether or not prenatal paternity tests are legally admissible to establish paternity in Arizona. The tests are very expensive, and before I pay I would like to know if I can use it
  • My landlord sent an email for us to pay past due rent by a certain date. We have been unable to do so. He has now sent another notice that he has labeled "move out demand" for us to vacate the property by this Sunday, Aug 19th. Is receiving this notices via email considered proper service? Thank you!
