QUESTIONS

  • I have a Health Care Advance Directive from another state. Some of my friends say it is valid, others no. I suspect it is really up to the local hospital/doctor whether to honor it. Can you tell me if there is an AZ law that REQUIRES hospital/doctor to follow it? If so, can you tell me the law (statue??) that applies so I can refer to it if necessary? Thank you
  • I rent with three other people one is planning on moving out by law is she required to give me a certain amount of notice before she moves?We agreed on end of month but she decided to move out tonight the end of the 18th with only giving me 4 hours notice.
  • In my lease it states I have to provide 30 days written notice (email will comply). My landlord told me I have to give notice for the full rent cycle and is trying to tell me we are obligated to pay another full moths rent. Do I have to give 30 days notice, or a full rent cycle notice? My intention is to move after the 1st of the next month but prior to month ending. Can I do so and provide a pro-rated amount of rent to my landlord or do I have to be out by the 1st?
  • Bio daughter lived with a boyfriend. Daughter has 4 children, 3 are from this relationship. CPS got involved due to domestic violence. Daughter failed to comply with CPS and father got all the chn including the child that is not of this relationship. Can I file for custody of this grandchild since he is not the biological father and he beats on woman.
  • I have two children with my ex we were never married he is actually still married to another woman. He signed the acknowledgment of paternity for my youngest daughter who is now 3 years old. I was wondering how I can take him off the birth certificate because he has not supported the kids since they were born no doctors appointment nothing I can not get legal documents like passports with out his signatures is there anything I can do to take his name off. He has been very violent and hit me several times and I have emails of him saying dangous things.

  • I have shared custody with ex husband (divorced 2005) with our 16 year old. He has had residential custody since 2011. He was abusive to our now 24 year old and has repeated physical and mental abuse with our 16 yr old. I can't afford legal counsel and live in a different state. What can be done from my current state of residence to obtain physical custody asap. The State Agency and police officers prior have stated that it's just discipline. What 200 lb man needs to choke, hold down on floor with knee in chest to discipline a less than 130 lb girl? Very smart. Honor roll student.
  • What if a landlord, (who after some research is not licensed or associated with management company, for which he claims) continues to ignore our pleas to fix the hazardous wiring, and flooring that is not disabled friendly? Also what if there are conflicting reports on a black mold inspection? We were told yes we do and the landlord refuses to clean the ducts because his report says no. I have been hospitalized 6 times, and when I have pneumonia, it gets worse each time, which caused me to have a O2 level go as low at 83 this last one. A high risk for retaliation, A fear of house safety.
  • This past February (2014) my kids father and myself came to an agreement that he would take the kids to school two days a week. However he takes them to school late often, they're not finishing homwork, and are loosing sleep because he lives far so theyre waking up about an hour earlier then when i have them. Is there anything i can do about this? Ive tried resolving this with him but he refuses.
  • I was a stay-at-home mom for the majority of my marriage. During that time I accrued some student loans. In our separation agreement we each agreed to pay half of that, and any other, debt. A lawyer I spoke with stated that I am eligible for alimony (we were married 9 years and I stayed home for 6 of them), but my spouse takes great exception to this. He believes that since I did not contribute, monetarily, I should not be entitled to alimony. What should my expectations be?
