I am curious about the 90 day requirement to file a lawsuit for a deficiency on a foreclosed home. In my case, I had a purchase money loan and a second mortgage from the same lender. After the foreclosure, the lender has continued to keep the second mortgage in an "open" status. Is the lender barred from suing on the second mortgage past 90 days of foreclosure or do they have up to the 6 year AZ statute of limitations to sue?

My roommate left a month ago to go back East to visit family. When he left as far as I knew he had every intention of returning. I have not heard from him in 3 weeks now. He is not returning my calls. He left his car in my garage & other personal items. I own the house & he rented a room. How long do I have to wait to get rid of his stuff? How do I find a record of payments made to me through Clearinghouse, my ex-husband stopped paying for 6 months because he changed jobs and says Clearinghouse screwed up the info. He has arreages of $1800.00 for those 6 months. He has been current since he finally set it up with Clearinghouse, but I need to show where he didn't pay. Can I get those records from Clearinghouse, and how????

I did not file for divorce and custody rights yet but if I will, is there any possibility that I could have the sole custody of my child? My husband has a history of domestic violence, extreme dui and issue from his ex-wife's son. I have a restraining order for him which was not served to him yet because I do not know where he's at now. Can I still divorce him even if I do not know the address? And get divorced too?
