Question: Does a restraining order stay on a defendant's record? If so, how long. The restraining order was for harassment. TA
Answer: If an order of protection is warranted and sustained by the courts, it is for the purpose of granting relief to the petitioner from the defendant. In no way does a restraining order result in being criminally charged. However, if the defendant is to be in violation of the order than they are subject to arrest and prosecution for the crime of interfering with judicial proceedings and any other crime that may have been committed in disobeying this order. The order will remain viewable to the courts and to the responding officers, but this is not part of one’s criminal record.
