Question: Where can I learn how to resign as executor of a will probated in Pima County, AZ?
Answer:
If a person is simply named in the Will and does not want to serve, but has not been appointed by the Court, typically that person simply types a letter stating that he or she is resiging and has it delivered to the person whose Will is at issue. If there is a probate and a person has been appointed by the court, that person will need to court approval in order to resign. Typically, he or she would file a Motion with the Court, asking to be replaced and send a copy to all interested parties. Then the person waits for the Court to sign an order releasing him or her from future obligations as Executor.
