Question: My stepfather has been admitted to a long term nursing home this year with Medicaid pending. Does my 81 year old Mother need to file taxes? Mom's attorney prepared the Medicaid application.
Answer: IRS tax filing requirements are based on multiple factors, but neither age nor residence in a long-term care facility (by itself) exempt people from filing, regardless of payment by Medicaid or Medicare. Generally, filing requirements ARE based on total reportable INCOME for a married couple, filing jointly (assuming that’s how your mother and stepfather normally filed their taxes). You can call the IRS for advice as to whether to file (800-829-1040). Then beginning February 1st, AARP provides FREE income tax filing services for low-income people.
