Question: My wife passed away on 1/1/13.She had an accounts in bank.They refused to let have her account balance (app $2,000?) without going to "probate".I'm very confused! What do I need to do ? Thank You
Answer: Legal advice, which includes recommended actions, is beyond the scope of AZLawHelp. However, according to A.R.S. § 14-6101, a bank account is a nonprobate transfer if the bank account had a payable on death designation. According to A.R.S. § 14-6223 (2), If the bank account included a payable on death designation, then that account may be distributed to the beneficiaries upon proof of death to the financial institution.
