Question: I'm renting a room from a lady who it turns out doesn't have even a lease or the right to sub-rent. I've paid my rent, but the landlord has gone into court to evict everyone. I have no monies as it's the 21st of the month and I don't get s/s till the third of the month. Do I have to live in the street?

Answer: As a subtenant, rights are limited, but not non-existent.  A subtenant would still need to be named in the lawsuit in order to have a judgment of eviction against that person.  Review the Arizona Residential Landlord Tenant Act.  This link includes a number of tenant resources.  a subtenant may wish to attempt to contact the landlord directly to negotiate the issue. If the subtenant has been served, and a trial date is set, that person should show up with evidence of payment of rents and proof that of residing there, and tell the judge their story.
