Elder Abuse

questions & answers

Question: My wife and I have been subject to badgering, intimidation, threatening and insulting language from the agent/park manager in the context of a home sale contract of our manufactured home. Would this type of behavior be considered some type of senior abuse, even though it is verbal but has an economic impact...I have some recordings too...

Answer: To be deemed liable for Elder Abuse in Arizona, a person must have special duties toward the elder individuals…something other than a business or contractual relationship. For example a caregiver or family member upon which the elder person depends could be liable for elder abuse. Elder “Financial Exploitation” also requires some special trust relationship. Arizona can also issue a Protective Order such as a “Injunction against Harassment”, to limit contact by an offending party, but that person must also have a relationship to you such as a family member or someone who has lived with you in the past. To be sure whether some protection is available, its best to contact local law enforcement or “Adult Protective Services” who will investigate the facts (APS Central Intake Unit (877) 767-2385, or use ther online form https://www.azdes.gov/landing.aspx?id=7436
