Question: My question is my ex boyfriend and I discussed taking out a title loan on our truck . We are both on the title. We agreed to do it but I’m the one that drove down and filed for the loan. So my name is primary on the Loan contract. After that he decides to leave me he takes our truck and blocks me so I can’t speak to him. He refuses to pay the loan payments. He also has our truck. I don’t think I should have to pay for a truck I no longer drive . They want the truck or their money ? What should I do?

Answer: You may want to consider voluntarily relinquishing the truck to the lender.  Could that lead to a deficiency judgment with you owing the difference between the cost of the truck and its current value?  Possibly.  Hopefully, you are maintaining insurance on the vehicle.  It is risky to allow the insurance to lapse.  It may be worthwhile to talk over your options with a lawyer.  It may save you money and heartache in the long run.  Bring all your loan documents to the meeting.  There are three programs in Arizona that you can use to get inexpensive legal advice and guidance.  One is the modest means program.  You will need to apply for the program and meet the financial qualifications.  Once you are qualified, Modest Means will send you a list of attorneys whose practice covers your area of concern.  You select a lawyer from the list and will be entitled to a one hour consultation for $75.  If you need additional help and if the lawyer agrees to take your case, the most you will be charged is $75 per hours.  the telephone number is (866) 637-5341.  Both Maricopa County and Pima County have lawyer referral programs that offer a 30 minute consult with an attorney.  Maricopa County's Lawyer Referral Service offers a 30 minute consult with an experienced attorney for $40.  The telephone number is  (602) 257-4434.  Pima County's Lawyer Referral Service offers a 30 minute attorney consult for $35.  The telephone number is (520) 623-4625.
