Question: a man is demanding I pay him for assisting me in selling a house I sold "by owner" I he is not licensed. He claims we had an oral agreement that I would pay him rather then hiring a realtor He is suing me for $5000
Answer: Arizona has a law called the Statue of Frauds ARS 44-101 which requires that certain contracts must be in writing in order for them to be legal. The sale and brokering of real property is covered under this statute: 7. Upon an agreement authorizing or employing an agent or broker to purchase or sell real property, or mines, for compensation or a commission.
