Question: When i was five years of age my father passed away.And for this reason i was awarded cash benefits to be only recieved at age eighteen.My gaurdian would also recieve benefits to help with cost of raising me.Since my family had issues with cps at a young age i was given to my grandparents.As i grew older family problems arose and havent spoke or recieved any help since age seventeen.I would like to know how i can go about recieving whats owed to me.At this time these benefits are badly needed since I have been on my own and i just want whats mine.PLEASE HELP ME!
Answer: If a revocable trust was created for your financial needs. It is possible that the terms of the trust can be changed through what is called a trust amendment. Contact a Wills and Trusts attorney to see if this is possible. Also, contact the trustee about the terms of the trust. For information relating to emancipation contact the Superior Court, read the document found at this link carefully. https://www.azcourts.gov/Portals/34/Forms/Emancipation/PetitionPkt.pdf The courts may order that the terms of the trust be changed to accommodate your needs if you have been emancipated. For further information on this matter contact an attorney. The Arizona Foundation for Legal Services and Education has a program for legal advice/representation for individuals at a reduced cost who meet a certain criteria based on monthly income and household size.
