Question: Do you have to have a legal advisor to file a motion for a new trial?
Answer: No attorney is necessary to file a new trial motion. The requirements for a Motion for a New Trial in a criminal case are contained in Rule 24.1 of the Arizona Rules of Crimnal Procedure. You may also want to look at Rule 24.2 related to Motions to Vacate a Judgement and Rule 32 on Post Conviction Relief. New Trial Motions in civil cases are governed by Rule 59 of the Arizona Rules of Civil Procedure. Rule 60(c) discusses vacating a judgement.
