Question: where do i go to file a small estate affidavit?
Answer: You do not file a small estate affidavit. This is what you do. First, you obtain a blank affidavit. Go to http://www.azcourts.gov and access the self-service center. Go to the county where you live and find the self-service center for your county. In Maricopa County you may need to look under law library resources at http://www.superiorcourt.maricopa.gov/SuperiorCourt/LawLibraryResourceCenter/Forms/ProbateCases/index.asp Once you have the form, fill it out and sign it in front of a notary or court clerk. Once you have the signed and notarized document, you can go to banks, Department of Motor Vehicles and other places. Present the affidavit to change the title on a vehicle, the name on a bank account, etc. The current limit for small estates in $75,000. That does not include assets held jointly with others or assets like life insurance with a named beneficiary.
