Question: I was in a car accident. The other driver's insurance company has offered to pay about $1000 -$1500 less than the Kelly Blue Book value for my car. The insurance company will not release my car until I sign the title over to them. The insurance rep will not provide documentation of how they determined the valve of my car. The rental car must go back today and I can't buy other car like mine for the amount they are offering. Is there anything I can do?

Answer: The other driver’s insurance company will typically pay “fair market value.” The Kelly Blue Book value is not always indicative of the fair market value. If you do not like what the other driver’s insurance company is offering, you will have to sue the other driver. It is generally better to submit claim to your own insurance company. The other driver’s insurance company cannot hold the car. It’s your car and you are responsible for it and have rights to it. You should seek legal counsel.
