Unfair Sales Practices and Consumer Fraud
questions & answers
Question: I allowed myself to be manipulated to sign an agreement for matchmaking service at 9 at night. The next morning I realized I could not affort it and I wrote a letter to cancel it (via e mail). They responded so I know they received it. The fine print on the contract I signed states the letter must be certified. My understanding is that certified simply ensures the recipient receives the letter. They did respond to e mail. Now, they are stating that they are suing me for the full amount and that I also signed that I must pay all legal fees. Do have any rights here? It has been 2 weeks. Thankyou
Answer: Much of this depends on what it states in the contract in reference the remedies for situations like this. You state you “signed” an agreement, so I assume you were in person and not on a website. I would suggest you speak with an attorney who works with contracts because just from your initial question, there MAY be some ways out; for example, if you were under duress when you signed the contract. There is case law that states when a company responds to an email, the company is put on notice of your intentions. Like I stated, without seeing what the contract states it is hard to provide a more thorough answer. Try and find a contracts attorney and they will be able to review the contract and provide more in-depth answers. Good Luck!
