Question: i sold a car to some one and it broke down as he was driving it home. he signed a bill of sale saying it was sold as is. do i have any legal responsability.

Answer:

Normally, a private seller is not held to the “implied warranty of merchantability,” as they usually don’t meet the definition of a merchant as provided by the Arizona Revised Statutes (A.R.S.), Section 47-2104.

Additionally, A.R.S. § 47-2316(C) states that “as is” or any other language that would commonly be understood as saying “as is” means that there are no implied warranties.  For more information on this topic, see our topic on Used Car Buying Tips.
