Question: can your wages be garnished by an employer without a judgment
Answer: Yes it is possible to have your wages garnished - the city or town magistrate can issue writs of garnishment for the repayment of fines, fees, sanctions, and restitution imposed in that court. However, in the vast majority of cases, per the same statute, a writ of garnishment can only be issued by a court in the case of a judgment. If the writ is properly filed on a valid judgment, 25% of your non-exempt earnings will be withheld. Source: A.R.S. §12-1598.02
