Question: I received a notice from the IRS saying that they will levy my Social Security check for non-payment of taxes. I am 70 years old. My only source of income is Social Security of $1798 per month. I have no assets. I live in an Assisted Living facility which I pay room and board of $1649 from SocSec and ALTCS benefits pay the balance. I am left with $109 per month for personal needs. Can the IRS levy 15% of my Soc Sec? How do I stop this levy?

Answer: You need legal help that is beyond the scope of this forum.  Telephone the Senior Citizen's Law Project at (602) 252-6710.  They may be able to provide you with a lawyer who can help.  You can also take steps on your own to consult with a lawyer.  There are 3 programs in Arizona that you can use to get some inexpensive legal advice and guidance.  One is the Modest Means Program.  For a $75.00 fee, the Modest Means Program will arrange a one hour consult with an experienced attorney.  The telephone number is (866) 637-5341.
