Answer: Under the Arizona Rules of Civil Procedure, you can file a motion asking for relief from a default judgment. The Rule is Rule 60 of the Arizona Rules of Civil Procedure. You must file as soon as possible after receiving the judgment. The absolute deadline for filing a motion for relief is 6 months from the date of the judgment. Your request for relief must be filed in the court where the judgment was entered. Your motion should state that you paid the $1000.00 on the debt. You would be best served by taking all your documents to a lawyer and getting advice. Do it as soon as possible. There are 3 programs in Arizona that you can use to get some inexpensive legal advice and guidance. One is the Modest Means Program. For a $75.00 fee, the Modest Means Program will arrange a one hour consult with an experienced attorney. The telephone number is (866) 637-5341. Both the Maricopa County Bar Association and the Pima County Bar Association have lawyer referral services that offer a 30 minute consult with an experienced attorney.
