Question: I was served with a civil court summons for an unpaid credit card debt.I was told before I stopped paying them,that it is an unsecured debt and I could not be force to pay it.two other banks that i couldn't pay any more have all ready written off debt as a bad debt.I have 20 days to respond in writing to the complaint. Can i be force to pay this by the court on this unsecured loan

Answer:

An unsecured debt basically means that the creditor has not required you to have collateral to support the financing the creditor granted you.  Unsecured debt does not mean that a creditor has no authority to sue you if you default on your debt to the creditor.  Yes some creditors will not pursue debtors through the courts, but some will exercise that avenue to collect the debt owed.
 
It would be wise to go to the Arizona website for fair debt collection rights, and see if there is any information which may help you out.
