Question: My husbands ex wife took out a loan on him without his permission and him being there. Is there any criminal or legal options to pursue her or is this something we have to civilly approach?
Answer: If she did not have the authority through a Power of Attorney to sign on his behalf, that would constitute fraud. He can file a criminal complaint with the police department and should also notify the lender of the fraud so they do not attempt to collect against him. He should gather the loan documents and provide them to the police department. He may also want to consider a handwriting expert to examine the writings on the loan documents and compare with his signature to prove it was not him that signed.
