Question: My husband passed away with no life insurance, leaving a few thousand in credit card debt. I am only an authorized user on some of these accounts and my only income is disability. Am I responsible for paying these debts?

Answer:

Arizona is a community property state. Under A.R.S. 25-211, property that is gained during a marriage is presumed community property, though there are exceptions. According to A.R.S. 25-214 and A.R.S. 25-215 debts incurred by one spouse during the marriage, are the responsibility of the community, meaning that both spouses would be jointly responsible for such debts, unless the debt falls into an exception in the statutes.  Whether a particular debt in question is the responsibility of both spouses is beyond the scope of AZLawHelp.org.  To find out how the law applies to a specific situation, contact an attorney directly.
