Question: Hello we recently had our wedding at a country club in Scottsdale. We have had multiple complaints that there were people under age being served liquor at the wedding. The country club even admitted to serving to one of the people. I have been going back and fourth with them in regards to why they were not asking for ID and they are coming up with an answer for everything. We already reported to country club that they were serving to minors but we want to know what we can do in regards to getting some of our money back. We paid almost 8000 for our wedding and had issues that night becuase of under age drinking and complaints. Out expectation of the country club was to ID people since we paid for an open bar. Is there anything else I can do besides reporting them? Thank You
Answer:
- The Arizona law relating to liability for serving alcohol at social events can be found in these statutes: ARS 4-301, 4-311, and 4-312. When serving alcohol to minors, ARS 4-311(a) says that a licensee is liable for property damage and personal injuries or to one who may bring an action for wrongful death. But, all elements (1, 2 and 3 of section a) need to be met in order for liability to stick - this, of course, is dealing with property damage or personal injury. Another option available would be to report the incident to the Arizona Department of Liquor Licenses and Control. Finally, speaking to an attorney to pursue further options is always an available option.
