Question: I received a summons for something I am unsure what it is about. The penalty codes for the summons are as followed ;J.C.R.C.P. 104(a) A.R.S. 25-215(B) and A.R.S 12-341 please help me to understand what the heck is going on.

Answer: J.C.R.C.P 104(a) is rule 104(a) of the Rules of Civil Procedure for Justice Court.  It basically describes who can be a plaintiff in a lawsuit.  A.R.S. 12-341 is the Arizona statute that allows a winning party in a lawsuit to collect its costs from the other party.  A.R.S. section 25-215(B) is the statute describing the liability of community property.  It states:  The community property is liable for the premarital separate debts or other liabilities of a spouse, incurred after September 1, 1973, but only to the extent of the value of that spouse's contribution to the community property which would have been such spouse's separate property if single."  It might be a very good idea to take the paperwork to a lawyer to find out more.  There are 3 programs in Arizona that you can use to get some inexpensive legal advice and guidance.  One is the Modest Means Program.  For a $75.00 fee, the Modest Means Program will arrange a one hour consult with an experienced attorney.  The telephone number is (866) 637-5341.
