Question: In Arizona, do I have the right to rescind/cancel a contract for cable tv services, if I did so because of misrepresentation by the cable company representative regarding cost savings and I cacelled in less than 24 hrs
Answer: Right of rescission According to Arizona law, a debtor may assert rights for a period of 90 days after receiving goods or services. The debtor may only assert rights as to amounts owing and as a defense to or setoff against a claim by the holder. The claims may be asserted only if the buyer gives notice of the claim or defense in writing, by certified mail to the seller, at the last known business address within ninety days of receipt of the goods or services. http://www.azleg.gov/FormatDocument.asp?inDoc=/ars/44/00145.htm&Title=44&DocType=ARS Service Fees If a person is thinking about canceling a service contract, they may need to check with their service provider. There may be a hefty Early Termination Fee (ETF) for cancelling contract before its terms. An ETF is a fee that you agree to pay to a service provider if you end a service contract before it expires. ETFs are included in contracts for a variety of services including wireless telephone service, cable and satellite TV, and health club memberships. ETFs charged by wireless telephone service providers vary greatly. Depending on your service plan and type of phone, there may be no ETF or the ETF may be over $300.
