  • What is the Arizona statute of limitations for a car loan on a repossessed car? 4 years or 6 years? When does it start running? After the first missed payment, or after the car gets auctioned off? Some people say the S.O.L. is 4 years because it is a car loan, and falls under this law: "47-2725. Statute of limitations in contracts for sale A. An action for breach of any contract for sale must be commenced within four years after the cause of action has accrued." Others say it is a written contract and therefore is subject to the standard 6 year S.O.L. Which one is correct?
  • I filed a small claims complaint against a former roommate of mine when after I decided to leave he only gave me some of my personal belongings back and kept other items that he knew were important to me. I won the case and received a judgment for the amount that I requested. However, in the complaint two of the items I did not place a dollar amount next to because I knew he was still in possession of them (two portraits drawn by my brother that are very dear to me) and I wanted them returned. He had indicated in his Answer that he was in fact in possession of those items but wanted to be reimbursed for framing them. The hearing officer indicated we would need to take up the matter in a different forum due to the fact that they were personal property that I wanted to have returned. After the judgment was ordered I prepared a letter to the defendant and requested that he return the portraits to me and deduct the cost of framing from the judgment and I would then give him a satisfaction of judgment and we would be finished with this matter. About two weeks later I received a check for the amount of the judgment and a letter stating that he no longer was in possession of the artwork (he did not state what in fact became of my portraits). I decided to have the artwork appraised as I had photographs of the artwork as well as other drawings my brother had done. I then prepared a demand letter, again in an effort to resolve the matter without going to court. He did not respond in the time in which I had requested - (20) days. My question is do I have the right to file a Complaint for Conversion of Personal Property requesting to be compensated for damages (the price for the artwork as well as punitive damages and costs incurred)? And, if so, can I still file in small claims court as long as the amount I am seeking does not exceed $2,500 exclusive of court costs?
  • We just rcvd ltr stating that our lease will not be renewed and we will have to move by end of April, 2020. The problem with that is COVID-19 and we also have four children under the age of eight with one child being on the learning spectrum. It is a very difficult time now during this pandemic to try to find another place to live, obtaining a moving company and just the stress of it all. We would still be able to pay our rent, so that isn't the problem, but do we have any rights as renters as we are renting a house not apartment at this time?

  • I am currently expecting a baby. The father of my baby left me when I was 7 months, but has stated he wants to be in the baby's life. He moved in with his mom, who keeps a very dirty house and has been in and out of the hospital with MRSA for the last couple of years. I do not feel like he can provde a safe and stable environment for my daughter. He believes he will get joint custody. What actions do I need to take to ensure this does not happen?
  • I'm the landlord and I want the people to move I had them evicted 8 months ago and then I felt sorry for them when they asked if they could sleep in their car in driveway with their 2 small children and their dog . I tried to evict them again last month for nonpayment of the utilities and failure to dispose of their huge pile of household trash , unfortunately I gave them a 24 hr notice to clean it up so I did not win the eviction , the verbal agreement was that they were to pay utilities water trash electric .   • I have not recieved any reciepts of my rental payments. I have to put the money in the landlords bank account. When i asked for a print out of all rent payments that I have, the landlord refused my request. Is there anything I can do to legally have my rent reciept records? i know he can not pull a back statement of his to show my rent payments were deposited, but shouldnt he give me a reciept of payments by law? I have never recieved a reciept after depositing the money and I thought that was kind of fishy. Please help, Its for my records and finances.
