QUESTIONS

  • If a rental agreement was signed by a person subleasing a room without the written or knowledge of the landlord is the lease still valid.
  • I have termite's in my apartment and have contacted the landlord 3 times regarding it. Nothing has been done in 2 weeks. Also leaks keep happening in my bathroom from the unit above.
  • My Park charged me a $5 per day late fee on unpaid late fees. Is this legal in Arizona? The park applies any payment made to the amount due, thus guaranteeing that any payment made that is less than the entire amount owed will be subject to late fees for the entire time additional money is owed. I believe there are laws preventing that practice for mortgages but I'm unsure about rentals or leases. Shouldn't payments first be applied toward the monthly rent or lease and then any additional payment be applied to late fees? And isn't it illegal to charge interest or fees on late fees?
  • My son was born in Arizona and we moved to Colorado. He has an AZ birth certificate. We have done a paternity test and have determined that the father listed is not correct. We have also had his last name changed. How do I get a birth certificate with his correct last name and father?

A bank is offering us a home loan that we assumed was fixed interest-the rate dropped a fraction, even-then I happened to notice an unfamiliar phrase with a tiny checked box-'demand feature'. I looked it up: the bank can demand payment, calling the loan, at any time without giving a reason. It said that some states prohibit that practice. Is Arizona one? Calling the loan could destroy us and force the property into foreclosure.

  • There was a pipe leaking by my parking spot for the last couple months. My water/sewer/trash Bill almost doubled for the last couple months. We pay w/s/t with our rent when it is due but we get a separate w/s/t bill and it shows that for almost 2 years my w/s/t was roughly the same until last month. The complex gets one bill and divides it by common area the apts pay the rest is divided to the residents. I believe the complex wasn't paying for their leaking pipe they were dividing it amongst the apt units. Can they legally do that?
