Question: My boyfriend and I bought a house together in December 2018, we’re going through a break up now and I need help figuring out what I need to do regarding the house.
Answer: Your course of action may depend partly on how the title to the home is held. Do the two of you own it as tenants in common or in joint tenancy with right of survivorship? Your question is not one that can be easily answered in an online forum like this. What discussions have you and your ex-boyfriend had about the house? Is one of you still living there? Your best bet if the two of you cannot agree on selling the house and splitting any proceeds is to talk to a lawyer. There are three programs in Arizona that you can use to get some inexpensive legal advice and guidance. One is the Modest Means Program. You will need to apply for the program and meet the financial need qualifications. Once qualified, Modest Means will send you a list of attorneys to choose from. Then, for a $75 fee, you will receive a one hour consultation with the attorney. Both Maricopa and Pima County Bar Associations have Lawyer Referral programs that offer a 30 minute consult with an attorney. It may be worth a small fee to get some legal advice and avoid making a costly mistake.
