Question: I have been living with this man for the last month and now we are broke up and he is withholding my mail could i get arrested for entering the home through the window? because he won't let me in .and he will not give me my mail.
Answer: Under the Arizona Criminal Code (A.R.S. Title 13), it is possible that a person could be charged with first-degree criminal trespass for unlawfully entering another person’s residence, even for the purpose of retrieving their own property. If you have asked him to give you your mail – ideally by email or text so that you have proof – and he has refused, then you may wish to contact the police. Theft or destruction of another person’s mail can be a federal offense.
