Question: I purchased a mobile home in Feb from a lady out of state (the mobile home is in apache junction, Az) Previous owner informed the tenants of the sale and asked that they vacate. Its now july and they are still there.. The title was misplaced so i just recently transfered it and served the tenants with a 5 day OMI. They refuse to go.. what do i do now..
Answer: I am not sure what you mean by an OMI. Have the tenants been paying rent? If you have served them with written notification of the sale and your intent to terminate the lease, have you given them a reasonable time to vacate and find another place to live? At least 30 days is usually considered reasonable. Did they pre-pay rent to the prior owners of the home? If you have followed all of the rules and the tenants will not leave, you will need to serve them with a special detainer action. (A.R.S. Section 33-1377). You will need to serve the tenants either by certified mail, return receipt or by the use of a process server with the summons and complaint. There will be a hearing in court where you will present your case and the renters will have an opportunity to argue their position. The key thing to remember is that all notices must be written notices.
