Question: I am buying a mobile home from the trailer park there was supposed to be repairs done before we moved in that weren't done and also any rain damage that we noticed after a rain, repairs have not been done and they keep telling us next week we signed contract 7/27 and mad our last down payment on 9/1 didn't get to move in until 9/26. Contract says as is but these are repairs they agreed to fix
Answer: It is always recommended that a prospective renter or purchaser get promises of future repairs in writing, either incorporated into the rental agreement or in a separate document signed at the same time as the rental agreement, because otherwise it becomes difficult to establish the details of what exactly was promised. Tenants are largely protected because the Arizona Residential Landlord and Tenant Action requires landlords to “maintain fit premises” (A.R.S. 33-1324). A purchaser whose purchase agreement says “as is” may find more success with the seller/landlord by making a formal request in a signed and dated letter.
