Question: I receives a 7 day notice to pay my lot rent. I will pay it within the 7 days. However, I received a notice on a bright red paper taped to my door the past 2 days saying my account is deliquent and due immediately. Is it legal for them to do that after giving a 7 day notice in which the 7 days have not expired yet?
Answer: If you are concerned that your landlord is going to attempt to evict you unlawfully, then you may wish to speak with an attorney. A landlord may not seek to evict a tenant for nonpayment of rent until the landlord has provided the tenant with a 5-day pay or quit notice then waited for 5 days beginning the day after the tenant received the notice (A.R.S. 33-1368(B)).
